U.S. District Judge Judith Levy, an appointee of former President Barack Obama who has made a big deal out of her lesbian identity, praised Edys Renan Membreño Díaz, a 30-year-old Honduran national currently serving state prison time for raping and sodomizing a woman with cerebral palsy and cognitive delays, as a “hardworking family man.”
Díaz raped the victim on two occasions: July 15 and July 17, 2022. He is now eligible for release in July 2028 after serving his state sentence.
Levy described Díaz as having lost siblings to violence in Honduras and supporting his mother financially, noting that he “expressed devotion to [his] family” and worked in the United States. The judge allowed Díaz to avoid an additional two years for immigration violations—despite having illegally entered the U.S. seven times—and imposed a $100 fine.
Federal prosecutors appealed the decision, arguing that Levy “unreasonably discounted the serious nature of the offense.” Assistant U.S. Attorney Meghan Sweeney Bean stated: “Despite six prior removals from the United States, Membrano Diaz returned and raped and sodomized a disabled American citizen.”
The Department of Homeland Security called the ruling “unspeakable depravity,” noting that the judge’s sentence was inconsistent with immigration law.
