America’s AI Dilemma: When the Path to Dominance Undermines Our Constitution

The current debate over artificial intelligence in America remains chaotic. Policymakers, technologists, investors, and activists cannot agree on the destination, strategy, acceptable costs, or even what constitutes victory in the race for artificial intelligence leadership.

This confusion excludes ordinary Americans from a discussion that will profoundly impact their jobs, businesses, institutions, and daily lives. Yet an America-first approach to AI must be designed not solely by Washington officials, Silicon Valley executives, or engineers, but by the people who build businesses, sign paychecks, raise families, and sustain the nation.

America’s technological framework should center on productive citizens rather than a small group of companies racing to create a cyber-utopia that reshapes the planet.

My July 4th forecast holds even more truth now than when I initially wrote it: No single political authority governs America’s technological future, and no shared moral compass guides it. We still have the Declaration of Independence, the Constitution, federalism, and each other. But most aspects remain unsettled.

Since July 4, tensions among AI experts have intensified following the release of Kimi, a Chinese open-source model that reportedly outperformed leading American closed-source systems on key benchmarks.

Kimi did not originate in isolation within China’s laboratories. Its developers trained it by distilling capabilities from American proprietary models—the very systems OpenAI and Anthropic claim must remain closed to maintain America’s edge.

This creates a critical issue. The U.S. has invested heavily in closed frontier labs. If Chinese engineers can replicate much of their practical utility at lower cost, Washington faces a dire choice: surrender global AI leadership to Beijing or allow the pursuit of AI dominance to transform its government into an unrecognizable form.

America’s historical model combines private innovation, free markets, and strategic federal investment. This approach has driven both prosperity and national power. But if collaboration between government and closed-source hyperscalers cannot maintain AI superiority, Americans deserve a conversation about the future—not a panic-driven shift of more power and resources to existing institutions.

How can America face an uncertain future when its greatest strategic advantage becomes a liability? Without public consensus on what replaces the old model—or even what kind of nation an “America” reborn should be—what path remains?

Currently, three factions within the AI community have emerged in response to this challenge.

The first faction argues that Kimi’s impact is less severe than portrayed. Chinese engineers did not universally surpass American frontier models; they optimized for high-stakes benchmarks and competed where open systems excel. Closed labs can adapt, Washington can adjust strategy, and American leadership may persist.

This view has some merit. Frontier labs still command vast resources, talent, and political backing. They won’t vanish simply because open models become more practical.

The second faction believes economic and political considerations will soon be obsolete. Its members anticipate recursively self-improving artificial superintelligence that could reshape or absorb human civilization. Their goal is to accelerate this transition under responsible management. If successful, we might enter an era of unparalleled fulfillment.

The test of an America-first AI policy lies in whether advanced technology strengthens the constitutional nation and its people.

One interpretation appears in Effective Altruism; another insists that America must lead the next superintelligence. Both frame maximum acceleration as a moral duty. From this perspective, open-source AI is perilous because it spreads capability, slows progress toward singular breakthroughs, and weakens institutional control over the race.

The third faction rejects the foundation of closed-source dominance. It argues that hyperscalers are pressuring Americans into funding their rise as private stewards of technological advancement. Companies gain unprecedented wealth and authority; Washington gains hopes for global AI leadership; citizens bear the costs and risks.

Kimi bolsters this argument because it excels in what businesses need: efficient computing, practical workflows, enterprise deployment, and web applications. Open models can undermine closed systems precisely where American economic life thrives—decentralized experimentation by workers, entrepreneurs, and firms.

Therefore, this faction advocates for America to embrace and encourage domestic open-source AI. The goal is not every model’s public release or the elimination of safeguards for frontier capabilities. Instead, it is that America’s technological framework should serve productive citizens rather than a few companies chasing an artificial utopia.

Of the three positions, the third offers the clearest path toward America-first AI because it begins with the right political subject: the American people. Technology should enhance their capacity to create, compete, govern themselves, and live well. They should not be treated as raw material for a government-corporate project aimed at controlling the future.

The first faction is also correct that closed frontier labs will remain part of the system. Some Americans genuinely seek investment in the most powerful models. The federal government also believes its security, economic, and geopolitical standing may depend on sovereign access to frontier AI.

This belief poses the greatest risk.

Washington might conclude that preserving global dominance requires control beyond civilian oversight. If officials must choose between the survival of the federal system and America’s constitutional order, “national security” could become justification for hoarding data, computing power, models, and authority on a scale never before seen.

China would then win without defeating America in the frontier race. By flooding the world with affordable, business-friendly open models, Beijing could entice Washington into becoming more centralized, secretive, and coercive—less recognizable as American.

America must refuse this trap. It should protect genuine threats to national security, preserve a competitive frontier sector, and create space for open models that empower American businesses and citizens. The test of an America-first AI policy is not whether it produces the most powerful machine at any cost. It is whether advanced technology strengthens the constitutional nation and its people.

If our AI strategy requires America to cease being America, China has already won.
